Eden District Council, as the Local Planning Authority (LPA), has statutory powers to protect trees that are of special amenity value. Several changes have been made to the legislation and the latest amendments came into force on 1 October 2008. Anyone wishing to do work on trees that are protected by a Tree Preservation Order (TPO) or are located within a Conservation Area must obtain the appropriate consent. Sometimes a planning condition will also protect trees as part of a landscaping scheme and permission may be required from the LPA before any work is carried out. There are some exemptions from this requirement to obtain permission or notify the LPA but if there is any uncertainty it is best to seek advice from the LPA or a professional advisor. The penalties for carrying out or allowing unauthorised tree work can be severe.

Eden District Council is responsible for looking after trees in parks and public open spaces. The Council responds to reports of hazardous or fallen trees in parks and public open spaces and undertakes an annual programme of tree planting.
